Prosecutors said he traded favors to enrich himself and then lied about it. Silver won a new trial when an appellate court overturned that conviction. His second trial ended in his conviction on May 11, 2018. Where is he now? Silver was sentenced in July 2018 to 7 years in prison. less

NEW YORK (AP) — A federal appeals court has reinstated embezzlement charges against a once-powerful New York legislator.
The 2nd U.S. Circuit Court of Appeals did so on Monday while upholding the conviction and five-year prison sentence for former state Sen. John Sampson on other charges.
It’s up to federal prosecutors to decide whether they’ll pursue another trial. They’re reviewing the decision.
The 53-year-old Brooklyn Democrat was convicted in 2015 of obstruction of justice and making false statements.
Now the appeals court says Sampson, who’s currently imprisoned at a New Jersey lockup, can be prosecuted on charges that were rejected by a lower-court judge.
Those charges allege he embezzled funds while acting as a court-appointed referee in home foreclosure proceedings.
Sampson’s lawyer did not immediately respond to a request for comment.
